10. Limitation of liability and indemnity

10.1 If you are a consumer, nothing in these Terms affects your statutory legal rights. You can obtain advice about your legal rights from Citizens Advice.

10.2 We cannot exclude or limit our responsibility to you for death or personal injury resulting from our negligence, fraud, or any liability which cannot be excluded under the Consumer Rights Act 2015 or the Consumer Protection Act 1987.

10.3 If you are using our systems for commercial purposes, we exclude all liability in contract or delict (including negligence) for economic losses, loss of revenue, profit, business, reputation, or data.

10.4 If you are a consumer, we are responsible for foreseeable loss or damage which you suffer as a result of our breach or failure to act with reasonable care and skill. We are not responsible for unforeseeable losses.

10.5 If you are not a consumer, you agree to fully indemnify us against all claims, losses, liabilities, and legal costs arising out of any breach of these Terms by you.

10.6 If you are a consumer, you agree to fully reimburse us for all losses and legal costs arising directly out of your material breach of these Terms or any illegal act committed by you while using our platforms.

11. Use of personal data, Data Security and Payment Security

11.1 Processing and Consent: We request personal information from you whilst you use our systems. This information will only be requested and processed in accordance with our Privacy Policy (www.passion-press.com/privacy) and the UK General Data Protection Regulation (UK GDPR).

11.2 Data Security and Encryption: We are committed to ensuring your personal information is secure. To protect your data during transmission, we use Secure Sockets Layer (SSL) and Transport Layer Security (TLS) encryption software. This ensures that any data exchanged between your browser or the Citadel app and our servers — including login credentials and personal preferences — is strictly encrypted.

11.3 Payment Security: We do not store or process your sensitive financial information directly. All subscription payments are handled securely through our authorised third-party payment processor, Stripe. Stripe operates under stringent, bank-level security standards (PCI-DSS compliant) and uses advanced SSL/TLS encryption to ensure your payment details are kept safe and confidential.

12. Terms and Conditions of Sale (Digital Products & Subscriptions)

These terms govern the purchase of any premium access, digital content, or digital subscriptions made via our Website or within the Citadel application.

12.1 The Digital Licence
When you purchase a subscription or buy access to premium digital content (including fiction, stories, and multimedia assets) via our platforms, you are not buying ownership rights to that content. Instead, PassionPress grants you a non-exclusive, non-transferable, revocable, personal licence to view, read, and interact with that digital content through the official Citadel app interface or Website solely for your private, non-commercial entertainment.

12.2 Delivery of Digital Content
All premium content and subscription tiers are digital. Delivery takes place instantly within the Citadel application or your web-based profile area upon successful payment validation via Stripe. Content is delivered by unlocking access permissions within your account. If you encounter any technical delivery or synchronisation errors, you should contact our support team immediately.

12.3 Usage Restrictions
You are granted access strictly for personal use. You must not:

  • Copy, rip, capture, download, or distribute our digital content outside the official, intended pathways of the Citadel application.
  • Share your account access or password with third parties to allow unauthorized access to paid content.
  • Use any content from Citadel to train machine learning models or artificial intelligence systems without explicit written licensing agreements from PassionPress.

12.4 Refunds, Cancellations, and Statutory Rights
The 14-Day Cooling-Off Period
Under UK consumer law, you have a statutory 14-day cooling-off period to cancel a digital content subscription or digital service purchased online without giving any reason.
When it applies: This period begins the moment your initial transaction occurs and the contract is formed.
Renewals and Trials: This statutory cooling-off window refreshes when a free trial period ends and rolls into a paid tier, or upon the automatic renewal of long-term contracts (12 months or more).
Loss of Right to Cancel: Please note that if you explicitly choose to stream, view, or consume premium digital content within those 14 days, you acknowledge that you are requesting immediate performance of the contract and you will lose your statutory right to a full refund for that active period.

12.5 Easy Cancellations ("Click to Cancel")
In compliance with UK legislative standards, we operate a transparent self-service cancellation process. If you signed up for a subscription tier online or via the app, you have the right to cancel it just as easily online. You can cancel your subscription at any time by navigating to your Account Settings page inside Citadel or on the Website and clicking the dedicated cancellation option. Your paid access will remain active until the end of your current billing period, and no further automatic payments will be drawn from your Stripe account.

13. General

13.1 We reserve the right to change the domain address of this Website and any services, digital products, subscription prices, specifications, and availability at any time.

13.2 Each of the sub-clauses of these Terms should be considered separately. If any are found to be unenforceable, invalid, or illegal, the remaining clauses will continue to have full effect.

13.3 These Terms are in English only. We will not lose our rights under these Terms by reason of any delay by us in enforcing them.

14. Governing law and jurisdiction

14.1 The Website and Digital Products are controlled and operated from the United Kingdom.

14.2 Business Users: If you are a business, these Terms are governed by the laws of Scotland and the courts of Scotland shall have exclusive jurisdiction over legal proceedings.

14.3 Consumer Users: If you are a consumer, these Terms are governed by the laws of Scotland and you can bring legal proceedings in the Scottish courts. If you live in England or Wales, you can bring legal proceedings in either the courts of Scotland or England and Wales. If you live in Northern Ireland, you can bring legal proceedings in either the courts of Northern Ireland or Scotland. If you live in an EU country, you can bring legal proceedings in either the courts of your home country or Scotland.
